    <Abstract>&lt;p&gt;This study aims to analyze the role of the Peace Court and the Dispute Resolution Council in interpreting and communicating the concept of “mā lā yuṭīqūn” in the Hadith of Rafʿ. The main problem addressed in the article is how the judicial system, while preserving individual rights and enforcing binding legal rules, can prevent the imposition of duties, obligations, or procedures that exceed a person’s real and customary capacity. The Hadith of Rafʿ, particularly the phrase “mā lā yuṭīqūn,” constitutes an important foundation in Imami jurisprudence for negating obligation in matters beyond human endurance and can also provide an analytical basis for judicial procedure, reconciliation, settlement, and legal responsibility. Using a descriptive-analytical method and relying on jurisprudential, legal-theoretical, and legal sources, the article shows that the Peace Court and the Dispute Resolution Council are not merely administrative mechanisms for reducing caseloads; rather, they can serve as institutional grounds for realizing humane, tolerable, and peace-oriented justice. The Peace Court, while maintaining its judicial authority, can play a significant role in identifying genuine incapacity, adjusting methods of enforcing obligations, reducing burdensome formalities, and issuing proportionate decisions. The Dispute Resolution Council, through dialogue, mediation, and reconciliation, can communicate the meaning of incapacity to disputing parties and guide them toward informed, fair, and enforceable agreements. The findings indicate that “mā lā yuṭīqūn” does not mean the absolute negation of responsibility; instead, it functions as a criterion for regulating responsibility according to the actual capacity of individuals. The study concludes that these two institutions, if they carefully distinguish genuine excuse from artificial claims of inability, can establish a balance between protecting rights, ensuring fairness, and preventing unbearable legal burdens.&lt;/p&gt;</Abstract>
    <OtherAbstract Language="FA">&lt;p&gt;این پژوهش با هدف تحلیل نقش دادگاه صلح و شورای حل اختلاف در تفسیر و تفهیم مفهوم «ما لا یطیقون» در حدیث رفع انجام شده است. مسئله اصلی مقاله آن است که نظام دادرسی، در کنار حفظ حقوق اشخاص و اجرای قواعد الزام‌آور، چگونه می‌تواند از تحمیل تکالیف، تعهدات یا فرایندهایی جلوگیری کند که از توان واقعی و عرفی افراد خارج است. حدیث رفع، به‌ویژه فراز «ما لا یطیقون»، یکی از مبانی مهم فقه امامیه در نفی الزام نسبت به امر خارج از طاقت است و می‌تواند در حوزه دادرسی، صلح، سازش و مسئولیت حقوقی نیز کارکرد تحلیلی داشته باشد. مقاله با رویکرد توصیفی ـ تحلیلی و با اتکا بر منابع فقهی، اصولی و حقوقی، نشان می‌دهد که دادگاه صلح و شورای حل اختلاف صرفاً نهادهایی تشکیلاتی برای کاهش پرونده‌ها نیستند، بلکه می‌توانند بستر نهادی تحقق عدالت قابل تحمل، انسانی و صلح‌محور باشند. دادگاه صلح با حفظ شأن قضایی خود می‌تواند در تشخیص ناتوانی واقعی، تعدیل شیوه اجرای تعهدات، کاهش تشریفات فرساینده و صدور تصمیم‌های متناسب نقش ایفا کند. شورای حل اختلاف نیز با تأکید بر گفت‌وگو، میانجی‌گری و سازش، می‌تواند مفهوم عدم طاقت را برای طرفین دعوا تفهیم کند و آنان را به سوی توافقی آگاهانه، منصفانه و قابل اجرا هدایت نماید. یافته‌های مقاله نشان می‌دهد که «ما لا یطیقون» به معنای نفی مطلق مسئولیت نیست، بلکه معیاری برای تنظیم مسئولیت بر پایه توان واقعی اشخاص است. نتیجه پژوهش آن است که این دو نهاد، در صورت تشخیص دقیق عذر واقعی از ادعای صوری ناتوانی، می‌توانند میان حفظ حق، رعایت انصاف و جلوگیری از تحمیل بار غیرقابل تحمل تعادل برقرار کنند.&lt;/p&gt;</OtherAbstract>
